The warranty for products such as pumps, valves and the like that HSL distributes or uses in the products it manufactures is specifically limited to the warranty made by the manufacturer of the product concerned. HSL's sole obligation under this warranty shall be to repair or replace any product which is found to be defective after examination by HSL's inspectors.

A product claimed to be defective must be returned, freight prepaid, to HSL after having first received HSL's written approval for such return. HSL at its sole option will replace the defective product with a comparable new product or repair the defective product delivered freight prepaid to the purchaser.

The warranty period application to any replaced product shall be ninety (90) days from the date of HSL's shipment or the balance of the original warranty period, whichever is longer. This warranty applies only when products are installed and used in accordance with HSL's printed instructions and accepted industry practice and , in particular, does not apply to products damaged by shipping or handling, improper installation, operation or maintenance, accident, neglect, or repairs or modifications made without authori zation by HSL.

HSL's total liability for any and all losses and damages arising out of any cause whatsoever shall in no event exceed the purchase price of the product in respect of which cause arises, whether such cause be based on contract, negligence, strict liability, tort or otherwise and, in particular, HSL shall not be liable for incidental or consequential damages.

The warranty provided above is in lieu of and excludes all other warranties, guarantees or conditions pertaining to the product, whether written or oral, statutory, expressed or implied, including any warranty as to suitability, fitness for any particular purpose, description or trade use and shall constitute HSL's sole obligation and liability and the original purchaser's sole remedy for breach of warranty.
